Inspired by the Rocky Mountain ADA Center’s recent research report which asks the question, “When is gender dysphoria considered a disability under the Americans with Disabilities Act,” this session explores just that – how have courts interpreted the ADA to apply – or not – to people who experience gender dysphoria. Join us as we navigate the intricate judicial interpretations surrounding this pivotal intersection. This is an area of the ADA that is far from settled and will benefit from additional case law and court scrutiny. This session will define several key concepts relating to this topic, review the ADA’s current statutory language regarding gender, and discuss the complex legal landscape developing around this topic. We will discuss relevant court cases on this issue, and the potential protection the ADA can offer to transgender people.
